About these terms and conditions (“Terms”)

These are the terms of use for Odd Box (“us/we/our”) which applies to all hire of our products and services.

Our Contract with you
We require booking forms to be completed and returned by email in order to place the booking. All details stated on the booking form will be taken as given unless we are otherwise notified in email or writing. Once you have filled out the booking form with respect to your hire requirements, you will receive an email from us acknowledging that we have received your request. This does not mean the booking has been accepted. We will send you a confirmation email with our contact details, details of the Product or Service you wish to hire (and any additional add-ons) for the requested event date (“Date”), the final full cost and an invoice for the deposit.  A contract between us will only be formed once we confirm receipt of your deposit or total balance for hire of the Product on the Date (“Booking”).  If a Product or Service is no longer available for hire we will inform you of this by email and your order will not be processed, or if a payment was taken you will be refunded in the full amount paid to us.

The Provider
Odd Box

The Customer
The person booking Odd Box for their event. The following contract and its terms comprise an agreement between the Provider and the Customer for the hire of the Photo Booth. This written contract sets out the full intentions of the parties and supersedes any previous written or oral agreements made between the parties.

Service Period
The Provider agrees to provide a Photo Booth operational and available for use for a minimum of 80% of the agreed service period, to permit maintenance of the Photo Booth should any be necessary.

Payment
A non – returnable deposit of 50% of the total hire balance is required to secure a reservation for the Photo Booth, the remaining total balance of the agreed rental charge is due 30 days before the Customer’s event. If the operator uses the equipment for a period in excess of the agreed service period additional rental charges will be payable by the Customer to the Provider, calculated on a pro rata basis. Payment of all additional rental charges must be made by the Customer before any additional service period commences.

Access, space & power requirements

The Customer will arrange for an appropriate space to be made available for the Photo Booth at the event venue. A minimum floor area of 2m wide x 2m long x 2m height is required. The Customer ensures that the Customer has obtained permission at the Customers venue to use a photo booth.

The Customer ensures that there is clear access to load and unload at the venue. The Customer must inform The Provider of any circumstances that would make setting the photo booth up more demanding, including going upstairs, long distances from unloading area to venue etc. The Provider will allocate a set period of time of 1 hour for setting up equipment at your venue which is included within your price, if there are any complications that are not made known to us beforehand then unfortunately this must be deducted from the hire time at our discretion.

The Customer will ensure the venue at the Customers event provides a mains electricity supply comprising a single 13amp socket located within the space designated by the Customer for the Photo Booth or safely within 10 metres ensuring no foot traffic is present in this area

Date changes & cancellations
Any request to alter the agreed date of the rental of the Photo Booth must be made via email or in writing and at least sixty days prior to the Customer’s event. Any change of date is subject to the availability of the Photo Booth on the alternative date and receipt of a new booking contract. If the Customer cancels an agreed rental of the Photo Booth up to sixty days before the rental date the deposit paid will be forfeit. If the Customer cancels an agreed rental of the Photo Booth within sixty days before the rental date the full amount will be forfeit.

Loss and/or damage to provider’s equipment
The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests . The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft, Fire, Flood or Accidental Damage. The Provider assumes complete responsibility for any loss of or damage to the Provider’s equipment caused by any negligence or fault by the Provider. The Provider shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft, Fire, Flood or Accidental Damage caused by due negligence or fault by the Provider.

Indemnification
The Customer agrees to, and understands the following:
a) The Customer will indemnify the Provider against any and all liability related to the Customer’s Event and use of the Provider’s equipment.
b) The Customer will indemnify the Provider against any and all liability associated with the use of any pictures taken at the Customer’s event by the Photo Booth or by its operatives, employees or affiliates.

c) In the unlikely event of your digital images being corrupt, lost or stolen the Provider will compensate up to the total value of £100.

The Customer agrees to, and understands the following:
All persons using the Photo Booth at the Customer’s event hereby give to Odd Box the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Photo Booth user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose. In addition the Customer, hereby releases, discharges and agrees to maintain the Provider free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy. In the event that the photo booth is not ready to commence at the agreed time due to a fault of The Provider, then The Provider will still give The Customer the agreed hire period by extending the finishing time of the hire. In the event that the hire does not start at the agreed time, as setup has been delayed due to any unforeseen circumstances that are no fault of the provider, then the hire will still end as per the agreed time on the booking form. In the event that The Provider has set up in time but the hire does not start at the agreed time due to over running of previous activities by The Customer or by The Customers venue, the hire will still end as per the agreed time on the booking form. In the event that The Provider has set up in time and The Customer or Customers guests experience technical issues with the photo booth The Customer agrees to contact The Provider as soon as possible and The Provider will promptly fix any potential issues to ensure the photo booth remains operational. If the Customer does not contact The Provider and inform them of any technical issues The Provider can not be held responsible for any loss of hire time if the Provider is not informed of any technical issues by The Customer as soon as possible. The Provider cannot be held responsible for any circumstances that may prevent The Provider from attending The Customers event, these may include but are not limited to severe weather conditions, traffic delays, breakdown of The Providers vehicles, sickness or equipment failure. In the case that The Provider cannot attend or fulfill your hire due to events beyond The Providers control The Provider will contact The Customer or The Customers venue as soon as possible. In these instances The Providers liability will be limited to refunding the total of monies paid. The Provider will not tolerate any abuse or threatening behavior to The Providers staff. If this does occur The Provider and Provider’s staff are within their right to terminate the hire. The Providers are also within their right to terminate a hire if they believe that any equipment or property belonging to the Provider is in danger of getting damaged or has been damaged due to unruly behavior from The Customers guests. The Provider also reserves the right to refuse guests admission into the photo booth if The Provider believes they are too unruly.  In any instances where The Provider believes there is a need to terminate the hire The Provider will always speak with the The Customer or Customers venue first to try and resolve the matter before terminating. If The Provider does have to terminate the hire due to reasons stated above, the full cost of hire is still payable and The Provider will not issue any refunds for hire time that has been cut short. The Providers photo booths are for indoor use only, unless discussed and agreed otherwise with The Provider before the hire, requires one mains power socket and must be on a completely flat & level surface. The Providers photo booths may be located within a marquee, but please note the above power and level surface requirements. The Provider is permitted to operate the photo booth until 11.00pm unless agreed otherwise, please note this does not include the tear down and load out time.

Please contact The Provider if you are unclear on any of these terms and conditions before you book a photo booth for your event. The Provider is happy to answer any questions you may have.

Miscellaneous terms

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforce-ability of any remaining provisions, or portions thereof. This is the entire agreement between the Provider and the Customer relating to the subject matter herein and shall not be modified except as agreed in writing by both parties. In the unlikely event that it is not possible, other than for reasons beyond the Provider’s control, to provide an operational Photo Booth for at least 80% of the agreed service period, the Provider shall either make a refund to the Customer calculated pro rata from the total charge made for the agreed service period or provide a grace period of operation in proportion to the time lost. Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event, the Provider will place the photographs on a web site which the Customer and their guests can access to place an order for prints of any photographs which will then be supplied and delivered by post, free of charge. If no service is received, the Provider’s maximum liability will be the return of all payments received from the Customer. The Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
